🛡️ Firearm Safety & Legal Guidelines
Your safety and legal compliance are paramount. Follow these guidelines for secure firearm transactions in Utah.
⚖️ Utah Gun Law Compliance
🚨 CRITICAL: Know the Law
- You must be 18+ to purchase a firearm from a private party in Utah
- You must be 21+ to purchase a handgun (federal law)
- You cannot sell to prohibited persons - if in doubt, use an FFL
- No straw purchases - buying for someone who cannot legally purchase
- Out-of-state sales must go through an FFL dealer
✅ Legal in Utah
- Private party sales to Utah residents
- No background check required for private sales
- Constitutional carry (no permit needed)
- Open carry and concealed carry
- No firearm registration required
⚠️ When to Use an FFL
- Buyer is from out of state
- You're unsure about buyer eligibility
- High-value transactions for peace of mind
- Buyer requests a background check
- Commercial sales (if you're a dealer)

🔍 Firearm Inspection & Verification
🔒 ALWAYS Follow the Four Fundamental Rules:
- Treat every firearm as if it's loaded
- Never point the muzzle at anything you don't want to destroy
- Keep your finger off the trigger until ready to shoot
- Be sure of your target and what's beyond it
🔍 What to Check
- Serial numbers - Verify they match paperwork
- Overall condition - Function, finish, wear
- Action operation - Smooth cycling
- Barrel condition - Check for obstructions
- Safety mechanisms - Test all safeties
- Included accessories - Mags, cases, docs
❓ Questions to Ask
- Round count - How much has it been shot?
- Maintenance history - When last cleaned/serviced?
- Modifications - Any aftermarket parts?
- Reason for sale - Why are they selling?
- Original accessories - Box, manuals, extra mags?
- Purchase history - How long have they owned it?
💰 Safe Payment & Transaction Practices
✅ Recommended Payment Methods
- Cash - Preferred for most transactions
- Cashier's check - For high-value items
- Bank wire - Secure but permanent
- Meet at bank - Verify funds in person
❌ Avoid These Payment Methods
- Personal checks - Can bounce or be fraudulent
- Money orders - Can be counterfeited
- PayPal/Venmo/CashApp - Prohibited by their terms of service
- Cryptocurrency - Irreversible and volatile
⚠️ Digital Payment Warning: PayPal, Venmo, and CashApp explicitly prohibit firearm transactions in their terms of service. Using them can result in account closure, frozen funds (up to 180 days), and loss of buyer/seller protection. Even coding transactions as "sporting goods" violates their terms and puts both parties at risk.
📋 Transaction Documentation
While not required in Utah, consider creating a bill of sale that includes:
- Date of sale and location
- Firearm make, model, caliber, and serial number
- Sale price and payment method
- Buyer and seller names and signatures
- Statement that buyer is legally eligible to own firearms
🚨 Red Flags to Avoid
⚠️ Suspicious Behavior
- Unwilling to meet in public
- Pressure to buy immediately
- Vague or evasive answers
- Won't provide ID or verify identity
- Asks unusual personal questions
💸 Payment Red Flags
- Price too good to be true
- Insists on unusual payment methods
- Wants to pay more than asking price
- Requests shipping instead of meeting
- Offers to "finance" the purchase
🔫 Firearm Red Flags
- Serial numbers filed off or altered
- No documentation or proof of ownership
- Recent acquisition with immediate resale
- Unwilling to let you inspect properly
- Claims "just needs a small repair"
